Preamble

The present Terms and Conditions are entered into by, on the one hand, Rigaud SAS, registered with the RCS PARIS B under the number 552 150 625 and located at 3 avenue du Président Wilson, 75116 PARIS, hereinafter referred to as “Rigaud,” and persons wishing to make purchases via the World Wide Web site rigaud-paris.com, hereinafter referred to as “the User” or “the Acquirer.”

Rigaud is a commercial brand operated by Rigaud SAS. Rigaud has a World Wide Web site, hereinafter referred to as “the Rigaud Site” and accessible directly via the URL http://www.rigaud-paris.com/.

Shipping of orders shall be broken down into five zones:

  1. Metropolitan France and Monaco;
  2. European Union;
  3. Europe outside the European Union;
  4. USA and Canada;
  5. French Overseas Departments, French Overseas Territories and the rest of the world.

The present Terms and Conditions apply exclusively to physical persons not engaged in commerce.

The parties hereby agree that their relations shall be governed exclusively by the present Terms and Conditions, to the exclusion of any term or condition previously available on the Site.

If a condition is found to have been omitted, it shall be governed by the procedures in place for the online sales sector for companies located in France.

Shipping Rates & Policy

Shipping costs will be paid by Maison Rigaud:

  1. for all orders of at least 100.00 € including tax (Metropolitan France and Monaco)
  2. for all orders of at least 150.00 € including tax (European Union, Europe outside the European Union)
  3. for all orders of at least 200.00 € including tax (USA and Canada, French Overseas Departments, French Overseas Territories and the rest of the world)

For any order of less than the above amounts, a participation in shipping fees is calculated on a fixed basis regardless of the weight of the order as per the following 5 shipping zones:

  1. Metropolitan France and Monaco : 8.00 €
  2. European Union : 20.00 €
  3. Europe outside the European Union : 35.00 €
  4. USA and Canada : 55.00 €
  5. French Overseas Departments, French Overseas Territories and the rest of the world : 85.00 €

Maison Rigaud commits itself to ship the articles ordered as soon as possible. The observed average processing and shipping time is 8 to 15 days for home delivery within Europe.

Delivery times are given only as an indication; should the delivery time exceed thirty days after the order was placed, the sale contract may be cancelled and the purchaser reimbursed.

Your packages may be subject to customs clearance and fees as well as import duties of the country to which you have your order shipped. Any customs or duty charges are always the responsibility of the recipient.

For the purpose of tracking current orders, an email shall be sent to the acquirer automatically at each stage in the processing of the order. The acquirer may also contact Rigaud using the contact information provided under the heading “Contact.”

Purpose

The purpose of the present Terms and Conditions is to define the modalities of sales between Rigaud and the User, from the placement order to the services, and including payment and delivery. They define all the stages necessary for placement of orders and tracking of said orders between the contracting parties.

Acquisition of merchandise or services via the present Site implies full and unreserved acceptance by the User of the present Terms and Conditions of Sale. Rigaud reserves the right to modify its Terms and Conditions of sale.

1. Products

The products offered for sale by Rigaud are those listed on the site the day of consultation by the User. The photographs illustrating the products are not part of the contract. If they had a wrong character or different appearance, Rigaud’s responsibility would not incurred.

While every effort is made to ensure that the color of the Rigaud products whose photos are posted on this site is accurate to the original products, differences may occur due to technical limitations of the color rendering of computer equipment.

Therefore Rigaud cannot be held responsible for errors or inaccuracies in the photos or graphical representations of Rigaud products on this site.

2. Orders

The User may place his or her order on line from the Site headings “Fragrances,” “Articles,” and “Gifts.” An order may not be placed via the Site unless the User has been clearly identified. Confirmation of the order implies acceptance of the present Terms and Conditions of Sale and recognition of full knowledge thereof. The seller shall send confirmation via electronic mail that the order has been recorded. The products offered for sale on the Site are in stock in our warehouses. An inventory discrepancy may result in insufficient stock of a given product. Our customer relations department will so inform the client via e-mail or telephone. Payment shall be debited only for products that are available. The client may elect to receive partial shipment of an order.

3. Cancellation of purchase

Purchasers who are physical persons not engaged in commerce have the right to cancel any purchase within a period of seven days beginning with delivery of their order and return the product to the seller for exchange or reimbursement without penalty, with the exception of the costs of the return.

In case of unavailability of a product after placing your order we will notify you by email as soon as possible, in which case you could apply for cancellation or exchange by calling at 01 46 75 03 66 or by contacting us by email at <contact@rigaud-paris.com>

4. Delivery

Once recorded, the order shall be delivered to the address provided by the User.

Rigaud hereby agrees to ship the articles ordered as soon as possible. The observed average processing and shipping time is 8 to 15 days for home delivery within Europe.

Rigaud entrusts shipping to partners who are recognized as being reliable; the company shall not be held responsible for loss or theft of an order.

All risks are incumbent upon the Acquirer from the time the products leave the Rigaud shipping facility. In case of damage in transit, a claim, with justification, must be made against the carrier within a period of three days to five days of delivery.

For the purpose of tracking current orders, an e-mail shall be sent to the Acquirer automatically at each stage of progress of the handling of the order. The Acquirer may also contact Rigaud using the contact information provided under the heading “Contact.”

5. Payment options

The User shall pay for purchases on line at the time of ordering via bank card – Visa or MasterCard.

Payment is due at the time the order is placed.

The purchaser’s account shall be debited only upon validation of the order, for the amount of the products shipped.

Rigaud makes every effort to ensure the confidentiality and security of the data sent via the Web. To this end, the Web Site uses an SSL (Secure Socket Layer) payment security module so that all information sent is encrypted by a software application and no third party may have access to it during its transit through the network.

Ownership of goods delivered to the User will not be acquired until after full payment of their price.

6. Prices

Prices are given in Euros, all taxes included. They are subject to change at any time.

They reflect the VAT (Value Added Tax) applicable on the day of the order. Any change in the applicable tax rate may be reflected in the prices of the products.

7. Guarantees

Product(s) not giving satisfaction: The Acquirer has a period of seven (7) working days within which to return, at his or her expense, the product(s) ordered should they fail to give satisfaction. Said time period begins with the day of delivery of the order. The product(s) must be returned in their original packaging and shipping material and be accompanied by the delivery slip, to the following address:

Products are returned at the risk and expense of the Acquirer.

If the aforementioned conditions are fulfilled, Rigaud shall reimburse the Acquirer for the amounts corresponding to the price(s) of the product(s) acquired within a period of thirty (30) days.

Non-conforming products: Any non-conforming product to be exchanged or reimbursed must be returned to Rigaud in its original packaging and shipping material and accompanied by the delivery slip, to the following address:

Upon reception of the product(s) deemed non-conforming, Rigaud shall make an examination of said product(s) as rapidly as possible. Should the non-conformity of the product(s) be confirmed by Rigaud, the Acquirer shall either be reimbursed for the amounts corresponding to the price of the product(s) acquired by him or her, or the non-conforming products shall be exchanged, within a period of thirty (30) days.

The costs of return and re-shipping of an exchange shall be incumbent upon Rigaud should the non-conformity be the result of an error on the part of Rigaud.

8. Signature and proof

Online entry of the number of the bank card and final validation of the order shall constitute proof of completeness of said order in conformity with the provisions of French Law No. 2000-230 of 13 March, 2000 adapting the law of evidence to Information Technology and relative to electronic signatures, and shall constitute payability of the amounts of the articles entered on the order form. Said validation shall constitute signature and express acceptance of all operations performed on the Site.

9. Liability

Rigaud’s obligation shall be limited to due diligence for all stages of access to the Site (order process, delivery, or subsequent services). Rigaud shall not be held liable for any inconvenience or loss inherent in the use of the Internet network, including but not limited to interruption of service, external intrusion, or the presence of computer viruses, or for any case such as may be construed as constituting force majeure, in conformity with jurisprudence or in cases of partial or total strike, disruption, including postal services, transport and communications, flood or fire.

The products sold on the Site are described and presented with the greatest exactitude. Should errors occur in spite of the precautions taken, Rigaud shall in no wise be held liable. Except in case of guarantee, any operation taking place between Rigaud and its customers and not contested within a period of six (6) months shall not be eligible for claim.

Rigaud will not be liable for all indirect damages including loss of profits, loss of opportunity, damages or expenses.

10. Intellectual property

All elements of the Rigaud World Wide Web Site, whether visual or acoustic, and including the underlying technology, are the exclusive property of Rigaud.

In accordance with the legislation pursuant to intellectual property, any reproduction, representation, or alteration, in whole or in part, of this Site or one of the elements comprising it is strictly prohibited.

11. Hypertext links

A User having a personal World Wide Web Site who wishes to place on said site, for his or her personal use, a simple link pointing directly to the home page of the Rigaud Site or any of its pages must have the prior authorization of Rigaud. However, any hypertext link to the Rigaud Site using framing or in-line linking techniques is strictly prohibited.

In all cases, any link, even if tacitly authorized, shall be removed at Rigaud’s request.

The Rigaud Site may contain links to other World Wide Web sites. Rigaud shall in no wise be held responsible for the content of such Sites.

12. Personal information

Rigaud reserves the right to gather data concerning the User, including by the use of “cookies.” The User may refuse cookies by enabling the corresponding option in his or her Web browser, or remove them; however, use of the Rigaud Site may be limited as a result. Rigaud may use said personal information at a later time in order to better inform users about Rigaud products and sales offerings or other types of operations, including those related to contests.

Rigaud hereby agrees not to transmit the identity and contact information of users of the services to any commercial partner not connected with Rigaud.

The User is hereby informed that he or she may elect at any time not to receive commercial messages by clicking on the Unsubscribe function appearing at the bottom of the e-mails.

In conformity with Article 27 of the French Law on Data Processing, Data Files and Individual Liberties of 6 January, 1978, the User has the right to access and to correct data concerning him or her, which right he or she can exercise:

  • by writing to Rigaud SAS – Services administratifs – 11-17 avenue de l’Epi d’or – 94800 VILLEJUIF – France;
  • or via e-mail at <contact@rigaud-paris.com>, specifying the nature of the request;
  • or by telephone at +33 (0)1 46 75 03 66;

The User is hereby informed that the system of automatic processing of information, and in particular management of users’ e-mail addresses, has been duly declared before the French Data Protection Authority, the CNIL.

13. Non partial validity

Should any provision of the present Terms and Conditions of Sale become null and void as a result of a change in legislation, regulations, or by virtue of a court decision, the other provisions of the present Terms and Conditions shall remain in full force and effect.

14. Duration

The present Terms and Conditions shall apply throughout the duration of the existence on line of the services offered by Rigaud.

15. Proof

The accounting register in computerized form, maintained in the information systems of Rigaud and its partners under reasonable conditions of security, shall be held to be proof of the communication, orders, and payments made between the parties.

16. Preservation and archiving of transactions

Archiving of order forms and invoices is performed on reliable and durable media so as to correspond to a faithful and durable copy in conformity with Article 1348 of the French Civil Code.

17. Governing law

The present Terms and Conditions shall be subject to French law. Assignment of jurisdiction in case of dispute, and failing amiable settlement between the parties, shall be to the competent Paris courts, even in case of claims on guarantees or plurality of defenders and even for conservation proceedings, summary procedures or upon application.
